general conditions of sale - Falkner Massagetische

The following conditions for sale are only valid for ordering and shipping goods from Messrs. Falkner Massagetische via Internet.  The conditions mentioned on our website at the time of placing the order are valid.  We do not accept conditions other than mentioned except upon our written confirmation. 

Our offer is limited to the countries Austria, all EC-countries and to Switzerland.  The language for the contract is German.  We are pleased to establish an individual offer for all other countries. 

§ 1 Conclusion of contract

1. The client gets an order confirmation. 
2. The sales contract is only valid after the client has received the order confirmation.

§ 2 Delivery time / shipping address / shipment

1. The normal delivery of the massage tables Tante Helga and Bruder Max is prompt, the massage table Der Falke can be shipped within one week, delivery of the massage table Sir Henry is within 14 days. 
2. If there is any delay in delivery, the client will be informed by mail or phone.   
3. Shipment is done to the shipping address mentioned by the client unless there is no other indication. There, the goods must be taken over by the client or by his authorized representative.   

§ 3 Complaints

1. The client is entitled to complain about the order within 8 working days upon receipt of goods.  Saturdays are no working days. 

§ 4 Conditions of payment

1. Payment terms for all models are: Payment in advance or cash on delivery.  The extra charge for payment cash on delivery is EURO 10,--  (Austria).

§ 5 Reservation of title

1.  The goods shipped remain the property of Messrs. Falkner until they have been fully paid.

§ 6 Ending conditions

1. Should one or more conditions of these conditions of sale become ineffective, this does not mean that the total contract will become ineffective, too.  The ineffective provision is replaced by the relevant legal provision. 
2. For this contract only Austrian law under exclulsion of UN-sales law is valid.
